Procedures To Undergo in Acquiring Land Documents as a Property/Real Estate Investor In Ghana.

Land acquisition in Ghana is faced with so many challenges. This is as a result of:

  • Rapid urbanization
  • Corrupt allodial/family/traditional land owners
  • High demand driven in the urban land market
  • Weak institutional framework

Due to these challenges, there is the need as an investor to contact a company or an expert (e.g., FNC Partners Ltd) that is well vested in this field to assist by walking you through the documentation processes.

The Stages:

  1. The investor needs a Site Plan and an indenture for a particular land that he/she wants to buy.
  2. He goes to the lands commission by conducting an official search based upon the site plan that they have given to him/her.
  3. The buyer /investor must always go with a certified surveyor to go and do the picking of the coordinates of the land he/she wants to buy.
  4. Basically, we have three types of official searches;
    • Lands commission search
    • Survey search
    • Title search
  5. After these three searches are done, the investor will get to know the rightful owner of the land before one is able to go ahead with the transaction.
  6. A certified surveyor has to take the investor’s/buyer’s validated ID Card that he/she has, to help prepare the biometric/barcoded site plan as well as the preparation of the indenture.
  7. The indenture will have to be prepared based on the three searches that was carried out (i.e., lands commission, survey and land title)
  8. The search information report (i.e., the family name) will have to be the same name on the indenture given to the investor/buyer by the seller/traditional land owner.
  9. One must also note that after the certified surveyor has prepared the site plan and the indenture, the family/ seller has to sign the documents. The seller/family then hands over the documents to the buyer/investor.
  10. After step nine-(9) the investor takes the documents to the high court for stamping. This will be followed by taking the documents to:
    • Land valuation for stamp duty
    • Survey and mapping for plotting of the land into the buyer /investor’s name
    • Land Title for certificate
    • Lands commission for publication
  11. For an investor to be fully satisfied that the land is in his/her name a new official search must be conducted to verify whether the portion of land  assigned to him/her is fully registered in his/her name.
